Abstract

The constitution has declared India as a ‘Democracy where only citizen can elect the government. Democracy will be futile without active participation of its citizens. The chief essence of democracy isFree and Fair elections. However election could be very notorious as it witness power drifts and clashed for the seat which could kill the essence of the fairness and freeness of election therefore a watch dog is required to check this menace so that every citizen could get its right. Thus to ensure a free and fair election, an autonomous body was created to meet the need of time. This autonomous body is insulated from executive influence
and political pressures. However organizing election is not easy, it faces huge challenges. Targeting the aforesaid situation the research has been made on doctrinal model of research relying on secondary sources. It aims to determine the essentiality of free and fair elections in democracy and the constitutional structure that commits towards elections being free and fair. It further tries to acknowledge the judicial intervention in the electoral process throughout the history and what it presently controls in terms of elections.
