Original Jurisdiction Of High Courts In The Light Of Constitution Of Pakistan

Abstract

The current paper is concerned with the study, appreciation, and analysis of High Court Constitutional Jurisdiction and related matters in their letter and spirit, in light of case-laws and other relevant rules and orders. High Courts in Pakistan issue authoritative directions under Article 199 of the Islamic Republic of Pakistan's Constitution in the form of Writs classified as Mandamus, Prohibition, Certiorari, Co-Warranto, and Habeas Corpus to office holders engaged in the conduct of the Federation, Province, or local authority's affairs and a check on judicial review over ultra-vires acts or omissions. Such powers are unrestricted in the case of a violation of fundamental rights. The remedy is subject to certain restrictions and limitations. This paper is a straightforward, up-to-date document written for practitioners, in which the procedure for enforcing the law and safeguarding the guaranteed fundamental rights is also described.
